Terms of Service

1. The Service

Pivot Ark provides AI-powered chat widget software for Shopify fashion retailers. The service includes lead capture, sizing intelligence, returns management, and analytics.

2. Your Account

• You must have a Shopify store to use the service
• You are responsible for keeping your credentials secure
• One account per Shopify store

3. Billing and Payment

• Subscription fees are billed monthly via Stripe
• Founding 40 members: 60-day free trial, then 40% off for life with promo code FOUNDERS40
• Standard trial: 14 days free
• Card required at signup, not charged until trial ends
• Cancel anytime before trial ends at no charge
• No refunds for partial months after billing begins
• We reserve the right to change pricing with 30 days notice

4. Data and Intellectual Property

Your store data belongs to you. This includes your conversation transcripts, leads, customer contact information, return records, and cart events. You can export this data at any time and request deletion upon cancellation.

By using Pivot Ark, you grant us a license to process your store's data to provide the service, including extracting anonymized sizing signals to contribute to our cross-retailer intelligence network.

Pivot Ark owns the aggregated, anonymized cross-retailer sizing intelligence network — including brand fit comparisons, sizing signal patterns, and return pattern data that has been stripped of all personally identifiable information. This aggregate intelligence is Pivot Ark's proprietary asset. Your individual store data never appears in the aggregate in identifiable form.

5. Acceptable Use

You may not:

• Use the service for stores outside of legitimate retail
• Attempt to reverse engineer the AI or intelligence systems
• Resell or white-label the service without written permission

6. Service Availability

• We target 99.9% uptime but do not guarantee it
• We may perform maintenance with reasonable advance notice
• Not liable for Shopify, Stripe, or third-party service outages

7. Limitation of Liability

Pivot Ark is not liable for:

• Lost revenue or profits
• Indirect or consequential damages
• Accuracy of AI-generated sizing recommendations (these are estimates based on historical data)

Maximum liability is limited to fees paid in the prior 3 months.

8. Termination

• You may cancel anytime from your dashboard
• We may terminate for violations of these terms with notice
• Upon termination, your data is available for export for 30 days then deleted per retention policy
